DUI: John Hendrix falls asleep behind the wheel after drinking at a friend’s house
41-year-old John Zachary Hendrix was asleep in his car in front of his friend’s Sigler Street Residence on April 15th. Officers conducted a welfare check near the location, where they observed Hendrix with what appeared to be an alcoholic beverage next to him in his cupholder before they woke him up. When he got up, he reeked of alcohol and told them that he was coming from “hanging out” at a friend’s house, which he was parked in front of. They asked him about the drink in the cupholder, and he said he had drunk it “long ago.” He could not recall when he left his friend’s or fell asleep. Then, he exited the car, unsteady on his feet, and took sobriety tests, where he performed poorly. Afterward, he told officers he did not want to take any additional tests, so they detained him, informed him of implied consent, where he refused to provide a chemical sample, and Mirandized him, during which he requested an attorney. During a further inspection of his vehicle, officers discovered the cup had remnants of alcohol, and the keys to his car, which is push-to-start, were in the other cupholder, readily available. Hendrix was then taken into custody for an implied consent violation, an open-container violation, and driving under the influence.
